HOLIDAY ACCOMMODATION TERMS AND CONDITIONS

1.     GENERAL
 
1.1  These terms and conditions apply to all bookings.
 
2.     TERMS ABOUT YOUR BOOKING
 
2.1   Deposit and Payment Terms
 
2.1.1  You must pay the Deposit within the number of days stated in the 'Confirmation of Booking'.  A deposit of 50% (25% if booked 3 months or more in advance) is required by the due date.
 
2.1.2  You must pay the final payment 28 days prior to the Arrival Date; or if you make your booking less than 30 days prior to the Arrival Date then payment in full must be made at the time of booking.
 
2.1.3  If the Deposit or final payment is not received by the due date, we may cancel the booking, without any requirement to notify you.
 
2.2    Cancellations
 
Bookings cancelled by you after acceptance by us or due to any reason for unavailability of the apartment, are subject to cancellation fees as follows:
 
2.2.1  The 50% Booking Deposit (25% if booked 3 months or more in advance) is non-refundable but is transferable to another date within the same property;
 
2.2.2  The balance (due 28 days prior to arrival) is non-refundable and non-transferable, unless the booking can be replaced. In that case a AUD$100 cancellation fee applies.
 
2.2.3 If you made payment through the online stayz payment system and you wish to vary or cancel your booking, please log into http://www.stayz.com.au/login and amend your booking.  Should you be eligible for a refund it will be made through the Stayz Online Payment System and then credited to the credit card linked to your booking.
 
2.2.4  If the booking is amended to reduce the number of nights, then this will be treated as a cancellation of the booking, as a result of the reduction in the number  of nights.

2.2.5  A booking may be cancelled by us due to unforseen circumstances resulting in the property being unavailable.  We will provide the opportunity for you to reschedule the booking to another date within the same property and this will not incur a fee.  A full refund in this circumstance will not be provided, if you are unable to reschedule the booking.
 
2.2.6  An administration charge of AU$100.00 will be charged for any variation or cancellation.

2.2.7  We strongly recommend that you consider arranging TRAVEL INSURANCE to protect against cancellation of the booking due to unforseen circumstances.
 
2.3    Prices, Payment Options & Invoicing
 
2.3.1  Prices are in Australian dollars and all payments must be made in Australian dollars.
 
2.3.2  Payment will only be credited when cleared funds are received.
 
2.3.3  We are not responsible for delays in bank or payment system processing. It is your responsibility to ensure that payments are received within the times specified.
 
2.3.4  Account details will be provided at the time of booking for Direct Deposit payments. Please ensure that you quote your surname in the receivers description field when the deposit is paid.
 
2.3.5  We are not liable for and are not required to honour any pricing displayed that is quoted in error. Confirmations are subject to re-issue if incorrect through error or omission and you agree to then pay the correct cost or to cancel the booking. A cancellation under these circumstances does not incur any cancellation fee.
 
2.3.6  Payments accepted include EFT (Electronic Funds Transfer) and/or credit card via secure online payments through stayz.com.  Payment through the stayz online payment system incurs a fee.
 
2.3.7  When using the Stayz Online Payment System, your Booking is split into two portions – the non-refundable deposit and the remaining balance. You may pay both portions (the full amount) in Australian Dollars, up-front or pay the deposit initially and subsequently pay the remaining balance.

Balance of the rental amount will be automatically debited 28 days (or thereabouts) prior to occupancy. If you have insufficient funds available for debit at that time you will be responsible for payment of all fees and charges. Where your stay commences in less than 4 weeks from the time of Booking, the full amount must be paid in full up front.

 
2.4    Arrival and Departure
 
2.4.1  All bookings include 1x on island arrival and 1 x departure transfers for up to 5 people. The Keys will be supplied on arrival and must be returned at departure.
 
2.4.2  Standard check in is 2pm and standard check out is 10am.
 
2.4.3  Late check in may incur a charge.  If you desire late check in then enquiries should be made at the time of booking.
 
3.     TERMS ABOUT YOUR OCCUPANCY
 
3.1   Conditions of use
 
3.1.1  You agree to ensure that all occupants treat the Property and all fittings with reasonable care and you agree to pay for any damage caused by misuse, neglect or abuse during your occupancy.
 
3.1.2  You agree to ensure that all occupants act in a manner that does not cause any nuisance or disturbance to nearby occupiers.
 
3.1.3  Pets are not permitted. This does not apply to seeing eye dogs.
 
3.1.4  You agree to comply with all applicable laws and with the regulations of Hamilton Island Enterprises Limited.
 
3.1.5  You agree to vacate the Property in a reasonably clean condition, including all barbeques and other fittings. Extra cleaning charges may be incurred for the cleaning of dirty dishes, washing machine, dishwasher, emptying the fridge, removal of excessive rubbish etc.  You agree to pay any additional costs over and above the normal cleaning fee which will be charged to your credit card.
 
3.1.6  Mobile telephone reception on the island is generally good. There is an internet café and there are several wireless internet hot spots on the island. Usual phone connections permit calls within the island only. Such calls are at no additional cost.
 
3.1.7  You agree to not exceed the maximum number of occupants specified in the Booking Agreement.  Only the guests nominated and agreed in the Booking may stay in the Property over night.  If any other guests stay, extra charges may apply or the agreement may be terminated without refund.
 
3.1.8   You are responsible for damage, breakages, theft and loss of the Property and any part of it during your stay. You must notify us of this immediately. We may recover from you, repair or replacement cost (at our discretion).
 
3.1.9  Smoking is not permitted in the Property
 
 
3.2   Security Bond
 
3.2.1   Credit Card details are required to be held as a Security Bond before your arrival on Hamilton Island.  Details required are, name on Credit Card, Credit Card Number, Expire Date and CVV.  Access to the property will not be granted until credit card details are provided.  We do not accept cash as a Security Bond.
 

3.2.2 You agree that we may process monies from the Security Bond to make good any damages.   Charges to the Credit Card will be made if there is reported any damage to the Buggy, Property or expense incurred as a result of your breach of these Terms & Conditions. Examples include but are not limited to any breakage, damage or excess cleaning requirements, extra Guests or Visitors beyond those declared. You will be notified before any transactions occur

 
3.3     Items left behind
 
3.3.1  You will be notified if any items are left behind on the Property that may belong to you.

3.4     Complaints/Problems
 
3.4.1  You must inform the booking agent as soon as possible if there is a problem or complaint in regards to your booking so that this can be rectified as quickly as possible.  Access for repairs or service to the property must be provided so this can be resolved.

3.4.2  Any complaint, which you feel is not being resolved, must be provided in writing to the booking agent prior to your departure from the property.

3.4.3  If these procedures are not followed, then this may delay the owner in rectifying the problem or complaint.
 
4.    TERMS ABOUT USE OF THE GOLF BUGGY
 
A golf buggy will be supplied complimentary for your use while staying at the Property. You agree that:

4.1  The buggy is supplied "as is". We are not liable to compensate you for the unavailability of the buggy, or for any defect or break down in the functioning of the buggy, regardless of cause.
 
4.2   The golf buggy will only be driven by an adult person with a valid driver’s licence, who is designated as a driver in the Booking Agreement;
 
4.2.1  You will be responsible for any damage caused during your stay. If any insurance claims arise you are to bear the excess cost of $500 for each and every claim. Age clause under 25 years is $1000 for each and every claim. Buggies are registered vehicles – Police and Island Security monitor driver behaviour, including breath tests.
 
4.3   You will not drive (and you will not permit any other designated driver to drive) the buggy:
 
4.3.1  Between 1.00 a.m. and 5.30 a.m. ( Hamilton Island buggy curfew);
 
4.3.2  With a blood alcohol content in excess of 0.05%, or while adversely affected by drugs (prescription or otherwise);
 
4.3.3  In any area sign posted "No Buggies" or "Restricted Area";
 
4.3.4  On any unsealed road, grassed area, air strip, beach or other "off-road" area;

4.3.5  Contrary to any road sign; or
 
4.3.6  Faster than 20 kilometres per hour.

4.4   You will drive the buggy (and will require any other designated driver to drive the buggy) in a safe and reasonable manner and in particular will ensure that a driver:
 
4.4.1  Does not contravene any Queensland road traffic regulations;
 
4.4.2  Does not contravene any Hamilton Island traffic regulations;
 
4.4.3  Does not carry more than the specified maximum number of passengers;
 
4.4.4  Removes the ignition key from the buggy when it is not in use.
 
4.4.4.1  If the buggy is stolen, in which case the occupant may need to cover any ignition replacement fees.  Replacement of unit keys- $20, Buggy key- $100.
 
4.5  You will return the buggy in a clean, tidy and undamaged condition, fair wear and tear excepted. You agree that tyre damage, under body damage, overhead damage and windscreen damage are not fair wear and tear.
 
4.6  You will use the buggy entirely at your own risk; and that we will not be liable for any loss, damage, personal injury or death resulting from your use of the buggy.
 
4.7  You agree to indemnify us against any loss or damage arising out of:
 
4.7.1  Any damage to the buggy or the Property, any injury to or death of any person, any damage to your property or the property of any third party and any consequential loss, cost (including legal costs) or expense of any kind arising out of the negligent use of the buggy by any person using the buggy with your permission;
 
4.7.2  Any charges claimed by Hamilton Island Enterprises Pty Ltd for parking or traffic violations while the buggy is licensed to you.
 
4.8  You agree that:
 
4.8.1  The cost of additional cleaning or repairs; and
 
4.8.2  In the event that the buggy does not operate, through misuse or negligence the owner is not responsible for a replacement buggy. The owner/agent will endeavour to resolve any problems to the best of their ability. No guarantee (refer clause 4.1).

4.8.2  Child Restraint Laws are adhered to in regards to the golf buggy
